These Terms and Conditions ("Terms") govern your access to and use of yeonsusa.com and all services provided by Yeon's America LLC, doing business as Yeon's America Staffing ("Company," "we," "us," or "our").
Yeon's America LLC is a staffing and on-site workforce management company headquartered in Auburn, Alabama. We serve manufacturers, warehouse operators, and logistics companies across Alabama and Georgia.
Acceptance of Terms
By accessing our website or engaging our staffing services, you represent that:
- You meet the minimum age requirements under applicable federal and Alabama state law for the position you are seeking (generally 18+ for most manufacturing and industrial roles; certain roles may be available to individuals aged 16–17 subject to applicable child labor laws and restrictions)
- You have the legal capacity to enter into binding agreements
- All information you provide to us is accurate, current, and complete
- You have read, understood, and agree to be bound by these Terms
- You will comply with all applicable federal, Alabama state, and Georgia state laws in connection with your use of our services
These Terms constitute a legally binding agreement. We reserve the right to update these Terms at any time. Continued use of our website or services after any changes constitutes acceptance of the revised Terms.
Description of Services
Yeon's America LLC provides the following services:
- Temporary staffing: Placement of workers in client facilities on a temporary or contract basis
- On-site workforce management: Dedicated supervisors stationed at client facilities to manage attendance, performance, and discipline
- Attendance tracking: Proprietary software-based monitoring of worker attendance and hours worked
- Same-day replacement: Rapid deployment of pre-screened replacement workers when absences occur
- HR compliance support: Assistance with disciplinary processes, documentation, and regulatory compliance
- Automated invoicing: Billing tied directly to verified attendance data
Specific scope, pricing, and terms of staffing services are governed by individual written agreements between Yeon's America LLC and each client company. In the event of a conflict between these Terms and a written client agreement, the written client agreement will control.
We operate primarily in: Alabama (Auburn, Opelika, Montgomery, Lanett, Valley, Tuskegee) and Georgia (LaGrange, West Point).
Website Use
Our website is provided for informational purposes and to facilitate applications and inquiries. You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of any third party.
You may not:
- Use the website to transmit spam, malware, or other harmful content
- Attempt to gain unauthorized access to any portion of the website or our systems
- Scrape, crawl, or harvest data from the website without our written permission
- Impersonate any person or entity, or misrepresent your affiliation
- Interfere with or disrupt the website's functionality or servers
- Copy, reproduce, or republish any content from the website without authorization
We reserve the right to deny access to anyone who violates these Terms, at our sole discretion.
Applicant Obligations
If you submit a job application or are placed as a worker through Yeon's America Staffing, you agree to:
- Provide accurate information: All information in your application, including work history, skills, certifications, and eligibility to work in the United States, must be truthful and complete. Providing false information is grounds for immediate termination.
- Work authorization: You represent that you are legally authorized to work in the United States. Yeon's America LLC complies with all I-9 Employment Eligibility Verification requirements.
- Drug and background screening: As a condition of placement, you may be required to undergo pre-placement and/or random drug testing and criminal background checks. Such screening will be conducted in accordance with applicable law, including the Fair Credit Reporting Act (FCRA), and will require your separate written authorization at the time of screening.
- Comply with workplace rules: When placed at a client facility, you agree to follow all applicable workplace safety rules and conduct standards of both Yeon's America LLC and the client company.
- Report issues: Promptly report workplace accidents, injuries, or safety concerns to your on-site Yeon's America supervisor.
- Attendance reliability: Report to assigned shifts on time and notify your Yeon's America supervisor as early as possible if unable to attend.
- Confidentiality: Do not disclose confidential information about client operations, processes, or proprietary information obtained during your placement.
Client Company Obligations
Companies that engage Yeon's America LLC for staffing services agree to:
- Maintain a safe workplace: Provide a work environment complying with all applicable OSHA regulations and industry safety standards
- Non-discrimination: Treat all placed workers in compliance with federal and state anti-discrimination laws, including Title VII, the ADA, and the ADEA
- Reporting: Promptly notify Yeon's America LLC of any workplace accidents, injuries, complaints, or disciplinary issues involving placed workers
- Timely payment: Pay all invoices within the terms specified in the written staffing agreement
- Accurate information: Provide accurate job descriptions, safety requirements, and attendance data
- No direct hire without authorization: Not directly hire or engage any worker placed by Yeon's America LLC without our prior written consent and payment of any applicable conversion fee specified in the staffing agreement
Employment Relationship
Workers placed by Yeon's America LLC are employees or contractors of Yeon's America LLC (or its affiliate Lims Industries LLC), not employees of the client company, unless otherwise expressly agreed in writing.
Client companies are not authorized to directly discipline or terminate placed workers without coordination with Yeon's America LLC's on-site management team. All disciplinary actions should be initiated through the designated on-site supervisor.
Nothing in these Terms creates a joint venture, partnership, or agency relationship between Yeon's America LLC and any client company beyond the scope of the written staffing agreement.
Intellectual Property
All content on the Yeon's America website — including text, graphics, logos, images, icons, software, and overall design — is the property of Yeon's America LLC and is protected by applicable copyright, trademark, and other intellectual property laws.
Our proprietary attendance tracking software, reporting systems, and operational methodologies are trade secrets and confidential information of Yeon's America LLC.
You may not copy, reproduce, distribute, republish, display, or transmit any portion of our website content without our express written permission. The Yeon's America name, logo, and related marks are trademarks of Yeon's America LLC.
Disclaimers
We do not warrant that:
- The website will be uninterrupted, error-free, or free of viruses or other harmful components
- Any information on the website is complete, accurate, or current
- Job placement is guaranteed to any applicant
- Specific positions, wage rates, or schedules will be available at any given time
We reserve the right to modify, suspend, or discontinue any aspect of the website at any time without notice.
Limitation of Liability
This limitation applies to damages arising from loss of profits, loss of data, reputational harm, business interruption, third-party conduct, or unauthorized access to your data.
To the extent permitted by law, our total cumulative liability shall not exceed the total fees paid by you to Yeon's America LLC in the three (3) months immediately preceding the event giving rise to the claim. For website visitors who have not engaged paid services, this limit is one hundred dollars ($100.00 USD). For client companies with a separate written staffing agreement, the liability terms in that agreement shall control and supersede this section.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by applicable law.
Indemnification
You agree to defend, indemnify, and hold harmless Yeon's America LLC and its affiliates (including Lims Industries LLC), officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms
- Your use of the website or our services
- Any false, misleading, or inaccurate information you provide
- Your violation of any applicable law or regulation
- Your violation of the rights of any third party
- Any workplace accident, injury, or incident resulting from your negligence or willful misconduct (for client companies)
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles.
For matters not subject to arbitration (see Section 13), you consent to the exclusive jurisdiction and venue of the state and federal courts located in Lee County, Alabama.
These Terms are subject to applicable federal laws, including the Federal Arbitration Act, which governs the arbitration provisions in Section 13.
Dispute Resolution & Arbitration
Informal Resolution First. Before initiating any formal proceedings, you agree to first contact us and attempt to resolve the dispute informally. We will work in good faith to reach a resolution within thirty (30) days.
Binding Arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved by binding arbitration under the American Arbitration Association Commercial Arbitration Rules. Arbitration shall take place in Lee County, Alabama. Yeon's America LLC shall bear the arbitration filing fees and arbitrator compensation for any claim brought by a worker or applicant that does not exceed $75,000; for all other claims, fees shall be allocated in accordance with the applicable AAA Rules.
Exceptions. The following claims are not subject to mandatory arbitration:
- Claims for emergency injunctive or other equitable relief to protect intellectual property rights
- Claims that applicable law expressly excludes from arbitration
- Claims within the jurisdiction of small claims court
Workers' Claims. Nothing in this arbitration provision limits any rights workers may have under the National Labor Relations Act, applicable wage and hour laws, or other non-waivable statutory rights.
General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy and any applicable written staffing agreement, constitute the entire agreement between you and Yeon's America LLC.
- Severability: If any provision is found invalid or unenforceable, the remaining provisions continue in full force and effect.
- Waiver: Our failure to enforce any right or provision shall not constitute a waiver.
- Assignment: You may not assign your rights without our prior written consent. We may assign our rights freely, including in connection with a merger, acquisition, or sale of assets.
- Force Majeure: Neither party shall be liable for delays resulting from causes beyond its reasonable control, including acts of God, natural disasters, pandemics, or government actions.
- Notices: All formal notices to us must be in writing and sent to the address in Section 15.
- Language: These Terms are written in English. Any translation is provided for convenience only; the English version controls.
